إشتد الإهتمام في السنوات الأخيرة بالفقه الإسلامي، وقد زادت العناية به في الأوساط الجامعية، ولا عجب في ذلك، فإن الشريعة الإسلامية قد تكفلت بتحقيق مصالح الناس في كل زمان ومكان، حيث أنها خاتمة الشرائع، ومصادرها الوحي الآلهي، ولذلك كان الفقه الإسلامي قادراً على أن يواجه المشاكل ويعطي الحوادث المتجددة بما يناسبها من أحكام.
وقد أدردك علماء القانون في الغرب ما إشتمل عليه الفقه الإسلامي من مرونة وصلاحية لحل مشاكل الحياة على مختلف أنواعها، فقرروا في عدة مؤتمرات أن الشريعة الإسلامية تعتبر مصدراً من مصادر القانون والتشريع العام وإنها صالحة للتطور، ومستقلة عن غيرها من الشرائع.
ولذلك كان لابد من دراسة هذا الفقه الخالد، ولكن لا بد من مدخل لهذا الفقه للتعريف به وبيان خصائصه كما يجب بيان أسسه وأصوله التي يقوم عليها، وتاريخه الذي إتخذه في نشأته وتطوره خلال العصور، وأهم قواعده وقوانينه التي يقوم عليها.
ولذلك فإن هذه الدراسة إهتمت بإلقاء الضوء على التشريع الإسلامي في جميع مراحله منذ عهد الرسول صلى الله عليه وسلم حتى عهد النهضة التشريعية، كما إهتمت الدراسة بأحكام الملكية والشفعة والعقد في الفقه الإسلامي.
