صدر قانون الإجراءات الجنائية رقم 150 لسنة 1950 في 3 من سبتمبر سنة 1950، على أن يعمل به بعد ثلاثين يومًا من تاريخ نشره في الجريدة الرسمية، ومذاك التاريخ أوجبت دواعي الحياة العملية على المشرع أن يدخل من التعديلات ما يراه محققًا للغاية منه في إرساء السبيل الموصل إلى الحقيقة لتعلن براءة البريء ويقضي بإدانة من أذنب، ولقد لمسنا مدى الصعوبة التي تواجه المشتغلين بالقانون في تتبع التطورات التشريعية لنصوص القانون والتي تبرز التطبيقات العملية مدى الحاجة إليها. ورأينا لزامًا علينا أن نقدم لمحراب العدالة نصوص قانون الإجراءات الجنائية بصورتها الأخيرة وقت نشر هذا الكتاب. ولكنا لم نقف عند هذا الحد، بل أوردنا أصل النصوص التي تناولها بالتعديل حتى يتيسر للباحث تبيان غاية المشرع ومراميه. واقتضى الحال- إتمامًا للفائدة المنشودة- أن نورد المذكرات الإيضاحية التي صاحبت النصوص المعدلة.
كذلك وضعنا في مسئوليتنا مراجعة أحكام محكمة النقض في خلال خمسين عامًا منذ 1928 حتى 1978، وتخيرنا منها بتدقيق شديد الأحكام التي أرست فيها محكمة النقض القواعد القانونية بالصورة التي يمكن بها أن يستغني الباحث عن مراجعة تلك الأحكام.
هذا، وقد أضفنا الأحكام التي صدرت عام 1979 بعد أن نشرها المكتب الفني لمحكمة النقض في أثناء هذا الكتاب.
وإنا إذ نقدم هذا الجهد إلى كل من يشتغل بالقانون، فإنما نرسي لبنة في صرح العدالة تيسيرًا لأعمالها بين أفراد المجتمع.
