تقليداً لسلفنا أود أن أسهم بهذا الجهد المتواضع تحت عنوان (موانع الرجوع في الهبة) دراسة مقارنة بين الفقه الإسلامي والقانون الوضعي ولهذه الدراسة المقارنة أهمية بالغة في وقتنا الحاضر حيث أصبحت مبادئ الشريعة الإسلامية مصدراً رئيساً للتشريع في مصر بموجب المادة الثانية من الدستور الدائم لجمهورية مصر العربية الصادر سنة 1971 هذا بالإضافة إلى غالبية الدساتير العربية تقرر مثل هذا الحكم. وموضوع هذا البحث قد جعلني أبحث وأنقب في ثمانية من مذاهب وهي الحنفية، والمالكية، والشافعية، والحنابلة، والظاهرية، والإمامية، والزيدية، مع الإشارة إلى مذهب الإباضية، وبيان أقوال الصحابة والتابعين من خلال تلك المذاهب، ومقارنة الجميع بما نص عليه المقنن المدني المصري وعلق عليه شراح القانون. وقد التزمت الحيدة، فلم أرجح من هذه الأقوال إلا ما يشهد له الدليل القاطع، أو يقويه الظن الغالب، لقوة حجة أو رجحان تعليل مع مراعاة أن يكون الإسلوب سهلاً حتى يستبين للقارئ ما يصبو إليه دون كبد أو عناء.
أما عن محتويات هذا الموضوع، فبعد ما سبق من مقدمة احتوت على أهمية الموضوع ومنهج البحث فيه، فإنها تشتمل على تمهيد وبابين وخاتمة وذلك على النحو الآتي: أولاً: التمهيد ويشتمل على بيان لكل من لفظي المانع والرجوع، ثانياً: الباب الأول: التعريف بالهبة وأحكام الرجوع فيها، وفيه فصلان الفصل الأول: تعريف الهبة والفصل الثاني: أحكام الرجوع في الهبة، والباب الثاني: موانع الرجوع في الهبة وفيه أربعة فصول الفصل الأول: مانع العوض، الفصل الثاني: مانع زيادة الموهوب، الفصل الثالث: مانع الخروج عن الملك، والفصل الرابع: مانعن تعلق الهبة بحقوق الغير، خامساً الخاتمة: وتشتمل على أهم النتائج التي توصلت إليها من خلال هذا البحث.
