تختلف حالة الأطفال عن حالة شرائح المجتمع الأخرى، فالأطفال لا يشكلون خطرا فكريا أو أمنيا على الدولة، ولا يهددون كيانها، وليست لهم أصوات يؤثرون فيها على الاتجاهات السياسية والاقتصادية والاجتماعية في الدولة، ولا يزاحمون سلطات الدولة في مناصبهم. وهم الشريحة الاجتماعية الوحيدة التي ليس لها القدرة على المطالبة بحقوقها؛ لهذا فإن المجتمعات الغربية لم تهتم بحقوق الطفل، مثل اهتمامها بشرائح العمال والفلاحين والمهندسين، وغيرها من التنظيمات المؤثرة في توجهات الدولة.
ومما ساعد في عدم الاهتمام بوضع الأطفال، هو أن الأطفال يعيشون في كنف الأبوين الذين يجهدان نفسيهما لإسعاد أطفالهما ويعملان من أجلهما. غير أن تشتت العائلة في الغرب بسبب الحروب الدامية، وزيادة الأطفال اليتامى، وتشردهم، وبروز حالات العلاقات غير المشروعة بين الرجل والمرأة، وزيادة عدد الأطفال مجهولي النسب، رتب على ذلك مشاكل عدة، حرمت الأطفال من الحماية الأبوية والأسرية، والرعاية الاجتماعية والإنسانية والاقتصادية والتعليمية، وازدادت نسبة تشردهم، وجنوحهم نحو الجريمة، واستغلالهم للقيام بأعمال غير أخلاقية وغير إنسانية.
وكان من نتيجة تطور المفاهيم الفكرية والتقدم العلمي والثقافي والفكري في الميادين كافة، أن تنبه المجتمع الدولي إلى وضع الأطفال، ووجد أنَّ من الضرورة أن تساير حالة الأطفال التطور الذي لحق بالطبقات الاجتماعية الأخرى، ولابد من أن يعمل على وضع قواعد لحماية شريحة الأطفال، قبل أن يتفاقم وضعهم، بعد أن وجد أن انتشار الجرائم من قبل الكبار تعود إلى سوء تربية المجرمين في مرحلة الطفولة.
