إن مسالك التعليل تعتبر أحد الأقطاب الكبرى في علمي الفقه والأصول على حد سواء، كما أنها تمثل نسفاً معرفياً متكاملاً، لكنه لا زال متوارياً خلف ركام هائل من الخلافات الأصولية ذات أبعاد متنوعة.
كما أن مسالك التعليل هي عمدة الإجتهاد والقياس على وجه الخصوص؛ فهي في النهاية آليات لتوسيع النسق الشرعي، وضمان حضور الشريعة للجواب عن المستجدات التي لا تتناهى.
ونظراً لأن دراسة مسالك التعليل من خلال إجتهادات الإمام أبي حامد الغزالي لها قيمة علمية خاصة، إذ تعد كتبه حلقة محورية في تاريخ الفكر الأصولي، فضلاً عن كونه أفرد الموضوع بتأليف خاص بين فيه مضايق التعليل ومسالكه التي أشكلت على معظم أهل العلم في عصره.
يهدف هذا البحث، الصادر عن مركز نماء، إلى الكشف عن حقيقة مسالك التعليل؛ أولاً بذكر مداخل منهجية ومعرفية تؤمن فهماً سليماً لها عند الإمام أبي حامد، وعند غيره من الأصوليين، ثم بتحديد مفهوم واضح لها، وبيان أنواعها وأقسامها، والتعريج على خصائصها وبنياتها الإستدلالية، وكذا أهم وظائفها المنهجية.
رصد المؤلف خلال البحث مواطن الإشكال في كل مسلك تعليلي، واستخرج خصائصه المنهجية، وبين مرتبته وموقعه من النسق التعليلي، كما بحث مكامن الضعف والقوة، غير قاصد الإستيعاب والإحاطة، بل الإقتصاد بقدر يظهر به المعنى.
كما سعى البحث إلى إظهار طبيعة الإشتغال المنطقي داخل المنظومة الأصولية من خلال حيثية مسالك التعليل، ومن شأن هذا العمل أن يجلي عدة قضايا في علاقة المنطق بالأصول: بياناً لمدى الإعمال وشروطه.
