الإمام محمد بن عبدالرحمن بن أبي ليلى وأصوله من خلال آرائه الفقهية
وبعد: فإن البحوث الموجودة الآن حول بعض الأئمة الذين اندرس فقههم وكذلك فقه بعض الصحابة والتابعين، إنما يقتصر على ما أعلم على جمع فتاواهم وهذا البحث قد ينعته بعضهم بأنه دعوى عريض؛ لأن مضمون العنوان يفيد أن لابن أبي ليلى فتاوى وأقضية؛ من خلالها يمكن استخراج الأصول التي بنى عليها فقهه.
والدعوى لا بد لها من بينة تص الإمام محمد بن عبدالرحمن بن أبي ليلى وأصوله من خلال آرائه الفقهية
وبعد: فإن البحوث الموجودة الآن حول بعض الأئمة الذين اندرس فقههم وكذلك فقه بعض الصحابة والتابعين، إنما يقتصر على ما أعلم على جمع فتاواهم وهذا البحث قد ينعته بعضهم بأنه دعوى عريض؛ لأن مضمون العنوان يفيد أن لابن أبي ليلى فتاوى وأقضية؛ من خلالها يمكن استخراج الأصول التي بنى عليها فقهه.
والدعوى لا بد لها من بينة تصدقها فكان لابد إذن من حشد كل ما وصلت إليه يدي من نصوص وإيرادها لتكون هي البينة على صحة هذه الدعوى سيما في الباب الثالث فالقول: مثلابأن ابن أبي ليلى يقول بالقياس؛ فهذا شيء معروف لا جديد فيه؛ لأنه يكفي للتدليل عليه÷ أن أثبت أن ابن أبي ليلى ينتمي إلى مدرسة أهل الرأي وذلك سهل يسير.
لكن عندما أقرر أن ابن أبي ليلى على خلاف أبي خنيفة وأصحابه يتوسع في القياس ويجريه في كل أصل أمكن تعليله سواء كان موضوع هذا الأصل الكفارات أو الحدود أوغير ذلك فهذا التقرير فعلا دعوى عريضة فلا بد من نصوص لعلماء ومن أمثلة من أقوال ابن أبي ليلى تجعل هذه الدعوى صحيحة أو قريبة من الصحة.
أضف إلى ذلك أن هذه الدراسة شعبة متخصصة من تاريخ التشريع الإسلامي والتاريخ ماته هي الوثائق، فكان إيرادي لنصوص العلماء دون تصرف غالباً بمنزلة هذه الوثائق.
