رأى هيئة مفوض المحكمة الدستورية فى الإشراف القضائى قبل التعديل, مواطن القصور فى النظام الأنتخابى قبل التعديل.
الحكم رقم 11 لسنة 13 ق دستورية بعدم دستورية جواز تعيين رؤساء اللجان الفرعية من غير أعضاء الهيئات القضائية, وتحديد معنى الإشراف والاقتراع وتحديد أعضاء الهيئات القضائية, أثر التعديلات التشريعية على نزاهة الانتخابات القادمة, خطاب عام إلى كل أطراف العملية الانتخابية.
وقد قامت خطة البحث فى هذا المؤلف على أولاً: إيراد النصوص القانونية المنظمة لمباشرة الحقوق السياسية وفق التعديلات وكذلك قوانين الاحزاب وأهدافها وبرامجها حتى يكون الجمهور بيئة من التنظيم التشريعى للعملية الأنتخابية.
ثانياً: إيراد النظام الإنتخابى قبل التعديلات وإيضاح نقاط الضعف فيه.
ثالثاً: إيراد النظام الإنتخابى بعد التعديل وإيضاح نقاط القوة فيه لبيان إنعدام إحتمال لتزوير الإنتخابات ثم توجيه خطاب لأطراف العملية الإنتخابية.
