موضوع حجية الحكم الجزائي من أكثر مواضيع القانون الإجرائي تعقيداً، كما أنه يعد موضوعاً ذا تماس مباشر مع العمل القضائي مما أتاح الفرصة لتقديم القضاء الكثير من التطبيقات بشأنه، وهو موضوع مهم وحساس، فمن ناحية يعد دليلاً قطعياً في الإثبات أو النفي بحسب الأحوال، وهو كذلك قيد يحد من حرية القضاء المدني في بحث مسألة ما باعتبار أن قضاءً آخر هو القضاء الجزائي سبق أن قال كلمته فيها، ويأتي هذا البحث لتوضيح الحالتين المشار إليهما. وبالرغم من أنه جاء في عنوان هذه الدراسة أنها "دراسة مقارنة" إلا أننا حصرنا المقارنة فيما بين قانونين فقط هما القانون الأردني والقانون المصري. وتقوم هذه الدراسة على الاعتماد على منهجين من مناهج البحث العلمي هما: 1-منهج البحث الاستنباطي: وتقوم من خلال هذا المنهج بتحليل النصوص القانونية المتعلقة بحجية الحكم الجزائي أمام القضاء المدني، إلى جانب بيان موقف الفقه والقضاء من هذه النصوص. 2-منهج البحث المقارن: من خلال هذا المنهج نضع النصوص القانونية في وجه بعضها البعض للوصول من خلال هذه المقارنة إلى أفضل الحلول المتعلقة بحجية الحكم الجزائي أمام القضاء المدني في القانون المدني الأردني والقانون المصري.
