إن هذا البحث يستمد أهميته وراهنيته من السياق التاريخي للظروف التي صادفها إعداده وتقديمه، حيث بدأت ملامح ثقافة النوع، المعبر عنها بالجندر (Gender)، في المجتمع المغربي عامة، وفي الأقاليم الجنوبية بصفة خاصة، تفرض نفسها في مختلف التجمعات والمنتديات، وفي أروقة الجامعات ونوادي المجتمع المدني بصفة عامة، إذ مافتئ الصبيب الإعلامي في ارتفاع مستمر للدعوة إلى محاربة جميع أنواع العنف الذي يستهدف النساء خاصة. وفي هذا السياق، يأتي هذا البحث المتميز ليجسد إسهاما جديا، ولبنة أساسية في بناء صرح قانون جنائي نوعي خاص، يمكن نعته بالقانون الجنائي الأسري. وقد وفق الباحث في تحليل وبحث أهم تجليات الانحراف في إطار العلاقة الزوجية، فيما له علاقة بالإخلال بما يفرضه الإحصان والعفاف المتجلي في الانزلاق إلى جنحة الخيانة الزوجية، بما لها من خصوصيات إجرائية تميزها عن أصلها الذي هو جريمة الفساد. ولم يكتف الباحث بمعالجة الخيانة الزوجية بمفهومها القانوني والاجتماعي في القانون المغربي وفي ضوء أحكام الشريعة الإسلامية، بل وسع دائرة نطاق بحثه ليستوعب ظاهرة الإكراه الجنسي بين الزوجين أو ما يعرف بالاغتصاب الزوجي في إطار القانون المغربي والمقارن، وفي ضوء أحكام الفقه الإسلامي. كما عرض الباحث صورا من المنازعات التي تنشأ عن الإخلال المادي بالالتزامات التي تفرضها العلاقة الزوجية كالمساكنة الشرعية، والأحكام المتعلقة بهجر أحد الزوجين بيت الزوجية، وإهمال الأسرة الذي ينجم عن الإخلال بواجب الإنفاق. وكل هذا إلى جانب العنف والسرقة في نطاق العلاقة الزوجية ومختلف صور الإيذاء العمدي وما يؤدي إليه من أضرار مادية ومعنوية وعاهات. وقد عالج الباحث دراسته في مقدمة و فصلين رئيسيين. تناول في الفصل الأول المنازعات الناشئة عن الإخلال بالإحصان والعفاف بين الزوجين، وفي الفصل الثاني تطرق للمنازعات الناشئة عن الإخلال بالمعروف والمساكنة الشرعية، وأنهاه بخاتمة تتضمن نتائج وتوصيات. ولابد من الإشارة إلى قيمة إضافية لهذا البحث تتجلى في قيام الباحث بتلخيص أهم مضامينه إلى اللغة الإنجليزية في نحو (40) صفحة مركزة.
