إن جمعية تنمية البحوث والدراسات القضائية بنشرها لهذه المجموعة ترغب في أن تضع بين أيدي ذوي الخبرة والباحثين أداة عمل أصبحت ضرورية لغايتين : الأولى، وتستخلص من الإجماع القائل بأن المجموعات المتوفرة غير كافية، فبعضها يبدو ناقصا بينما البعض الآخر تطبعه عدم الدقة. أما الغاية الثانية، فهي ناتجة عن التداخلات التشريعية العديدة المسجلة في المسطرة الجنائية منذ سنة 1959 والتي لا تساعد على التحديد الدقيق للقواعد الجاري بها العمل. والحال أن أغلب المجموعات التي تم نشرها حتى اليوم، عبارة عن نصوص متراكمة تدل عن مدى تطور المسطرة الجنائية بدون أي توافق فيما بينها أو مواكبة. وقد تم إعداد هذه المجموعة قصد سد هذه الثغرة. وهكذا فإن جميع التعديلات التي طرأت، من جهة، على المسطرة الجنائية تمت فهرستها وإذخالها، وأشير إلى المراجع في هامش الصفحة بكيفية دقيقة. ومن جهة أخرى، فإن النتائج المترتبة عن التنظيم القضائي الجديد، وكذا الظهير بمثابة قانون رقم : 1-74-448 المؤرخ في 28 شتنبر 1974 والمتضمن للاجراءات الانتقالية… تم استخلاصها والإشارة إليها في نقط. وهكذا سيكون اهتمام القارىء أو الباحث منصبا على مختلف التعديلات التي أدخلت بكيفية غير مباشرة على القانون الأصلي. وتتمنى جمعية تنمية البحوث والدراسات القضائية أن تكون قد قامت بعمل مجدي ونافع، كما تعتمد على الملاحظين والنقاد والمشتغلين بهذه المجموعة بأن يعملوا على تحسين مضمونها ومحتواها بإتقان وانتظام.
