يعاني مرفق الحالة المدنية من خلال مزدوج : في التشريع وفي التطبيق. طال الأمد على هذا الوضع دون أن تتحرك يد الإصلاح لتداركه. الخلل في التشريع يرجع جانب منه إلى قدم النصوص وظروف إصدارها، ويرجع جانب آخر إلى " الفتاوي" الدينية والقانونية التي تفسر بها وزارة العدل ووزارة الداخلية النصوص القائمة. والخلل في التطبيق، منه كذلك ما هو ناجم عن عدم توفير الإمكانيات مثل رقابة النيابة العامة للسجلات، ومنه ما هو ناشىء عن اللامبالاة إن لم يكن الإهمال… وأطروحة السيد النافعي تناولت الجوانب الأساسية للخلل السالف الذكر. ويتعلق الأمر بالتعميم والتمديد، والضبط… فأبرزت أسباب عدم التعميم والتمديد، وغياب الضبط والسلبيات المترتبة عن ذلك، مع اقتراح الوسائل التي يراها الباحث كفيلة بتحقيق الأهداف المرغوب فيها من نظام الحالة المدنية… وما يميز أطروحة السيد النافعي أنها ليست بحثا منفصلا عن الواقع وإنما كل ما ورد فيها من تحليل كان منطلقه الواقع الذي يعيشه مرفق الحالة المدنية، فبالإضافة… تتبع الباحث المناشير التي أصدرتها الكتابة العامة للحكومة ووزارة الداخلية ووزارة العدل… بل تمكن الباحث من توثيق كثير من الوقائع...
