يكتسي هذا الكتاب أهمية بالغة لاسيما وأنه يجمع بين موضوعين يحتلان اليوم مكانة بارزة في مجال الأعمال؛ من جهة العقار الذي يعتبر أداة مهمة لا غنى عنها في أي مشروع اقتصادي، ومن جهة ثانية مسطرة التسوية القضائية التي تعتبر أهم مكونات مساطر صعوبات المقاولة، نظرا لأنها لا تسعى فقط إلى حماية الدائنين وسداد ديونهم، بل أيضاً إلى حماية المقاولة نفسها عن طريق ضمان استمرار نشاطها والحفاظ على مناصب الشغل المرتبطة بها . وطبعا، فإن الجمع بين هذين الموضوعين في إطار دراسة أكاديمية يعتبر في نظرنا جرأة قل نظيرها، تنم عن رغبة واضحة من قبل الباحث في إغناء المكتبة الوطنية بمرجع يحاول سبر أغوار موضوع شغل بال المهتمين ولاسيما القضاء، وهو موضوع "الوضعية القانونية للعقار خلال مسطرة التسوية القضائية للمقاولة" في محاولة للإجابة عن إشكالية أساسية تتمحور حول مدى نجاح المشرع في التوفيق بين حماية الأصول العقارية للمقاولة التي تشكل الضامن الأول لاستمرارية نشاطها وبين حماية حقوق الدائنين لاسيما أصحاب الضمانات المعلقة على هذه العقارات. وقد أبان الباحث في هذه الدراسة عن مستوى رفيع في التحليل وتمكن من أدوات البحث التي تجعل من القارئ يستمتع بقراءته ويجد فيه إجابات شافية على العديد من التساؤلات التي تثار على أرض الواقع خاصة وأن البحث جاء غنيا بعمل قضائي غزير في هذا المجال، مما يجعله بحق قيمة مضافة للمكتبة القانونية المغربية.
