إن القراء الذين سبق لهم ان شرفوني وقرأوا لي كتاباً مما سبق أن كتبت في هذه المواضيع المتصلة بالشريعة أو الإسلام، لا ريب أنهم يعلمون ويعرفون منه وعني فيما يعرفون أنني أقم بمثل هذا البحث، لا كما يقوم به رجل من ررجال الدين، أو من علماء الشريعة، مهمته الأولى هي الدفاع عن العقيدة، أو عن الشريعة، وإنما أقوم به رجلاً من رجال البحث العلمي، يبحث أولاً عن الحقيقة، فيعرض في كل مسألة مختلف وجهات النظر، ويزن آراء المؤيدين والمعارضين بميزان البحث والفحص والدرس والنقد، ثم يدافع عما يؤمن به أنه الحق: لوجه الله، ولوجه العلم، ولوجه الوطن ولوجه الحق، وبذلك وضعت خطة بحث لهذا الموضوع تنقسم إلى أربعة مباحث نختتمه بخاتمة: (المبحث الأول: نعرض فيه وجهة نظر الرأي القائل بعدم صلاحية الشريعة كمصدر أساسي للدستور، المبحث الثاني: نعرض فيه وجهة نظر الرأي القائل بصلاحية الشريعة كمصدر أساسي للدستور، المبحث الثالث: نخصصه لمناقشة ما يستحق أن يكون موضعاً للمناقشة من مختلف الآراء، وسوف نمهد لتلك المناقشة ببعض مباحث "يتضمنها المطلب الأول" نلقي بها بعض الأضواء أما القراء قبل أن نستمد منها أضواء تنير أمامنا طريق نقاش مختلف الآراء، والمبحث الرابع: سنبين فيه الأسباب التي تدعونا إلى مناصرة الرأي القائل بصلاحية الشريعة كمصدر أساسي للدستور، وذلك إلى جانب ما يكون قد سبق لنا بيانه، فنتكلم عن "سمو الشريعة الإسلامية" فيما شهد بذلك علماء القانون في الغرب والمؤتمرات الدولية للقانون المقارن ثم نتكلم عن مظاهر سمو الحضارة الإسلامية وما ذكره المؤرخون والعلماء الغربيون عنها، وأخيراً نبين أن من تلك الأسباب ملء أو سد الفراغ الثقافي والتشريعي، وفي الخاتمة: نبدي بعض ملحوظات عامة نضع على رأسها دور كل من علماء الفقه الإسلامي وعلماء القانون للنهوض بالشريعة الإسلامية).
