مكملات مقاصد الشريعة عبارة عن : الأمور التي تنظمّ لمقاصد الشريعة لحمايتها وتقويتها وتحسينها ، بحيث إذا فقدت أو اختلت لم يخل ذلك بوجود أصول المقاصد ، لكنها توجد على غير وجه الكمال والتمام . ويدخل في المكملات : الأسباب ، والشروط ، وعدم الموانع ، وفتح الذرائع ، وسدها ، وأوصاف المشروعات ، وتوابع العبادات ، والجوابر ، والتعويضات . ومراعاة مكملات مقاصد الشريعة لها أثر جليل في تحقيق التوازن والاعتدال في الفتاوى والاجتهادات والآراء والتصرفات ، ومن لم يك ذا دراية بفقه المكملات والعلاقة بينها وبين المقاصد وما يقدم منها وما يؤخر فسوف يقف حائراً عند اشتباه المسائل عاجزاً عند التباس المسالك في النوازل العبادية والمالية والطبية والسياسية وغيرها ، هذا إذا كان لديه ورع يحجزه عن التقول على الله بغير علم ، أما إن لم يكن لديه ورع يزكيه فربما اعتبر المكملات وإن عادت على مقاصد الشريعة بالإبطال ، وربما أهمل المكملات وهي جديرة بالمراعاة والإعمال ، ويظهر أثر ذلك جلياً في قضايا الأمة ونوازلها الكبرى . وقد فتح أبو حامد الغزالي باب التأليف في المكملات ، ووسعه أبو إسحاق الشاطبي ، مع وجود إلماحات وتطبيقات عند غيرهما من العلماء ، وفي العصر الحديث اكتفى المعاصرون بعرض روح نظرية المكملات عند الشاطبي . وهذه الدراسة التي بين يديك – أخي القارئ – جهد مركز في مكملات مقاصد الشريعة تأصيلاً وتطبيقاً على بعض المسائل المعاصرة ، آملين أن تسهم في تقويم الفكر والسلوك المعاصر ، وأن تلفت نظر الباحثين إلى تتبع الفراغات البحثية فيما يتصل بمقاصد الشريعة وبيان أثرها في الواقع ، وبالله التوفيق .
