الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد سيد الخلق وخاتم النبيين والمرسلين وعلى آله أجمعين. لقد ارتأيت أن أكتب في هذا الموضوع، قانون منع الجرائم رقم (7) لسنة 1954م، لما لهذا القانون من أهمية وخطورة كبيرتين من حيث التطبيق، وذلك أنه يتصادم ويتداخل، لا بل ويلغي القوانين الجزائية الدستورية (قانون العقوبات، وقانون أصول المحاكمات الجزائية) التي تطبقها المحاكم النظامية صاحبة الاختصاص والولاية العامة في نظر جميع المنازعات والدعاوى بمقتضى نصوص وقواعد الدستور (القانون الأعلى) والتي نصت على ضمانات للسلطة القضائية، وكفلت لها الحماية من التدخل في شؤونها، كما ونصت على ضرورة تنظيم المحاكم وحمايتها. وقد سن المشرع الأردني مجموعة قوانين خاصة تحقيقاً لهذه الغاية وامتثالاً لقواعد وأحكام الدستور. وهذه القوانين: قانون استقلال القضاء، وقانون تشكيل المحاكم النظامية. إلاّ أن قانون منع الجرائم لم يحترم نصوص وقواعد هذه القوانين الدستورية، ولم يحترم نصوص وقواعد الدستور أيضاً، وتجاوزها وعطلها وألغاها في كثير من الأحيان، وذلك بأن أعطى الحاكم الإداري صلاحيات واختصاصات وسلطات قضائية لا بل وأعطاه الحق في إنشاء محكمته الخاصة به، كما وأعطاه الحق في محاكمة الأشخاص المُحضَرين أمامه بمقتضى قانون منع الجرائم وإصدار الأحكام بحقهم حتى لو لم يرتكبوا أفعالاً يجرمها القانون ويعاقب عليها، أو حتى بعد صدور حكم قضائي بحقهم عن المحاكم النظامية الدستورية صاحبة الاختصاص والولاية العامة في إصدار الأحكام القضائية، والذي غالباً ما يكون بعدم مسئوليتهم أو بمنع محاكمتهم أو ببراءتهم.
