لم يكن القانون بمنأى عن شبكة الإنترنت، إذ أصبحت الشبكة سبيلاً مهماً لنقل وتبادل المعلومات القانونية إلى المهتمين بها، ويسرت تنظيم المعاملات والعقود على إختلاف أنواعها، وفرضت نفسها على العالم كله بوصفها البديل الحديث عن التعاقد عبر الوسائل التقليدية، فأصبح في وسع أي شخص أن يتعاقد عبرها، أو أن يطلب سلع وخدمات، او أن يقوم بسداد أو سحب مبالغ نقدية، وهو قابع في منزله وعلى مقعده، فيصل إلى ما يرغب إليه من خلال الضغط على لوحة المفاتيح الموجودة في كمبيوتره الخاص، الذي يكون متصلاً بالشبكة من خلال وسيلة الإتصال الهاتفية، دون أن يتجشم عناء الإنتقال إلى المكان الذي توجد به السلعة أو الخدمة المطلوبة، فظهرت في الأفق القانوني، العقود الإلكترونية، أو تلك التي تعقد عبر شبكة الإنترنت، أو عقود التجارة الإلكترونية.
ولقد طرح التعاقد عبر شبكة الإنترنت على حداثته مشكلات قانونية متعددة منها على سبيل المثال، وضعيات أموال المعلوماتية التي يغلب على جزء مهم منها الطابع غير المادي بدءاً بالبيانات المحوسبة وبرامج الكمبيوتر وصولاً إلى قواعد بنوك المعلومات وشبكات الإتصال، وأصول حماية هذه الأموال وتحديد ماهية النظام القانوني الواجب التطبيق بشأنها وقياس عمق تأثيراتها المباشرة وغير المباشرة في صلب الفروع القانونية القائمة ولا سيما في مجال القانون المدني، والقانون التجاري، والقانون الدولي الخاص، والقانون الجنائي، وقانون المرافعات والإثبات.
لذلك، تناول هذا البحث الأحكام الخاصة بالتعاقد عبر شبكة الإنترنت والوسائل المدنية المقررة لحمايته وذلك في فصلين: الفصل الأول: ماهية وإنعقاد العقد الإلكتروني عبر شبكة الإنترنت، الفصل الثاني: الحماية المدنية للتعاقد عبر شبكة الإنترنت.
