تثير مسألة الرقابة الدستورية على القوانين واللوائح مدى سلطات المشرع العادي المختلفة. سواء كانت منعدمة أو تقديرية أو مقيدة إزاء قواعد الدستور واحكامه، وفي إطار موضوعات القضاء الدستوري، يتعين مراعاة بعض المبادئ العامة، إذ يجب عدم الخوض في المسألة الدستورية إلا إذا كان ذلك لزاماً وضرورياً للفصل في الخصومة الأصلية، مع مراعاة قرينة الدستورية لمصلحة التشريعات بقصد تفادي اثارة المشكلة الدستورية، هذا مع استبعاد البواعث وملاءمات التشريع من نطاق الرقابة. وكذلك أعمال السيادة واستنادًا إلى ما تقدم، يتعين تقسيم محتويات هذا البحث إلى الفصول الآتية: (الفصل الأول: الدعوى الدستورية، الفصل الثاني: الدستور وتفسيره ومبدأ خضوع الدولة للقانون، الفصل الثالث: الرقابة القضائية على الشرعية الدستورية، الفصل الرابع: الرقابة الدستورية على سلطة المشرع العادي في سن القوانين، الفصل الخامس: تحديد النطاق الزمني للتشريع في إطار القواعد الدستورية، الفصل السادس: حماية حقوق المتهمين في التحقيق والمحاكمة، الفصل السابع: حق التقاضي، الفصل الثامن: مبدأ حرمة المراسلات، الفصل التاسع: حرية التنقل، الفصل العاشر: حجية الأحكام الصادرة في الدعاوى الدستورية وأثرها على قضاء الموضوع، الفصل الحادي عشر: حكم المحكمة الدستورية العليا).
