يقصد بتحديد نطاق القانون التجارى تحديد دائرة ومجال تطبيقه, فالقانون التجارى ليس إلا أحد التشريعات الخاصة المتعددة, لذلك كان ضرورياً أن يحدد بدقة ووضوح مجال تطبيقه, ولما كان القانون التجارى هو مجموعة القواعد القانونية التى تنظم البيئة التجارية من تجار وأعمال تجارية, فإنه بهذا المعنى يضم القواعد التى تتلائم وطبيعة وظروف النشاط التجارى ويستقل بها عن قاون المعاملات المدنية الذى يعتبر الإطار العام للقانون الخاص, لذا فمن الضرورى تحديد نطاق تطبيق قواعد القانون التجارى حتى تتضح الحدود الفاصلة بين قواعده وقواعد القانون المدنى (المعاملات المدنية), وفى هذا الكتاب نتعرض لقانون التجارة الداخلية والخارجية وذلك من خلال خمسة فصول هى: قانون التجارة, مفهوم التجارة الدولية, الحواجز التجارية, الممارسات التجارية غير العادية وأخيراً شروط التجارة الدولية.
