Book Description
يتناول موضوع التحكيم وموقف الشريعة من الصلح، وكيفية اختيار الحكم وشروطه، ومزايا التحكيم. ويتبع ذلك دراسة لبعض مواد قانون التحكيم رقم 4 لعام 2008 الخاص بالتحكيم في المنازعات المدنية والاقتصادية والتجارية، ويبين ضرورة إدراج مادة في العقد مستقلة في نهايته تبين الصيغة المناسبة للتحكيم، مع توصيةٍ هامةٍ أخيرةٍ تتعلق بالوصية والتزام العدل وأحكام الشريعة فيها.
ثم يورد قانون التحكيم الصادر عن رئاسة الجمهورية العربية السورية بتاريخ 18/3/1429 هـ الموافق لـ 25/3/ 2008 م، والمتضمن أحكاماً عامةً واتفاق التحكيم وهيئته وإجراءاته وحكم التحكيم والطعن به، وحجية أحكاك المحكمين وتنفيذها ومراكز التحكيم مع أحكام متفرقة.
