القضاء هو أحد أبواب الفقه الكبرى، ومظهر أساسي من مظاهر سلطان الدولة، ومعلم رئيسي من معالم الحياة العملية الضرورية، لإقرار الحق وقمع الباطل، وإعلاء مظلة العدالة، ومقاومة الظلم وتطويق الجور، وهو بصفة بارزة في الإسلام ذو أهمية واضحة، لأنه يجسد سمتين بارزتين وهما: 1-الصبغة النظرية لأحكام الشريعة القائمة على أصول الحق والعدل والمساواة. 2-والصبغة العملية وهي الأهم لعنايتها بالتطبيق، وترجمتها مبادئ الإسلام وأحكامه ونظامه العام إلى واقع عملي ملموس بين الناس.
ومهمة القاضي الرئيسية هي الفصل في الخصومات، وهذه المهمة خطيرة جداً، لأنها عون على إطفاء نار المنازعات، والحدّ من استفحال الخصومات واستمرارها، ويتوقف ذلك على مهارة القاضي وفراسته، وتوفيقه في التوصل إلى الحقائق في ثنايا كلام الخصوم ويستعين القاضي في سبيل إنجاح مهمته على أصول التقاضي وتجارب مشاهير القضاة، ومن أقدمها وأشهرها كتاب النبي صلى الله عليه وسلم إلى العلاء بن الخضرمي الذي ولاه القضاء على البحرين، ورسالة الإمام عمر بن الخطاب رضي الله عنه إلى أبي موسى الأشعري.
وتبلورت هذه الأصول القضائية في ممارسة النبي صلى الله عليه وسلم القضاء في عهد النبوة، وتابعه في ذلك الخلفاء الراشدون، ثم الأمويون، ثم العباسيون، وكان القاضي شريح التابعي في عهد الإمام عمر والإمام أبو يوسف قاضي القضاة في عهد الخليفة العباسي الرشيد من أعلام القضاة المسلمين الذين يهتدى بمنهجهم وسيرتهم، وهذا ما أبرزه القاضي مجاهد الإسلام القاسمي، في كتابه هذا، كما أنه لم ينسى أن يلقي الأضواء الكاشفة على نظام القضاء في الهند، وأدوار رجالاته في إرساء معالمه وتنظيم هذا المرفق الحيوي.
