إن مزاولة المهن مكفولة بمقتضى القوانين لكونها نتيجة طبيعية للحرية الشخصية، إلا أن ذلك لا يعني إطلاقها دون ضوابط أو قيود، لأن مزاولة أي مهنة قد تفرض على صاحبها القيام بنشاط معين.
ويحدث أن يكون هذا النشاط ضاراً بالغير مما يوجب التعويض عنه وهذا الأمر استلزم وضع قواعد قانونية ملزمة تعمل على تنظيم سلوك من يزاول هذه المهنة وتحدد علاقته بالغير وترتب مسؤوليته عند مخالفته لتلك القواعد القانونية.
غير أن نصوص القوانين المدنية لم تكن كافية لتحديد المسؤولية القانونية لأرباب المهن، مما أدى إلى القول بضرورة وضع قانون مدني مهني يعالج مسؤولية أرباب المهن بحسب الطبيعة الخاصة لإلتزاماتهم، لأن هناك إحتياطات يغتفر للرجل العادي أن يغفلها، فإن لم يراعها رجل المهنة عد ذلك إغفالاً أكيداً منه لواجباته وخطاً محققاً من جانبه.
كما أن القضاء قد وسع من مهمته فلم يعد دوره قاصراً على تفسير النصوص القانونية وتطبيقها وأنما تعدى ذلك إلى إنشاء قواعد قانونية جديدة لكي تسد النقص الذي يتخلل ثنايا هذه النصوص القانونية.
ومن هنا، تتضح الحاجة للبحث في مسؤولية الصيدلي المدنية عن أخطائه المهنية، فمع التطور الكبير في مجال صناعة الأدوية والذي ساهم بشكل واضح في المساعدة على الشفاء من أغلب الأمراض والقضاء على كثير من الأوبئة، إلا أن هذا التطور ظل مصدراً للقلق وسبباً في إزياد فرص المخاطر التي تهدد الحياة البشرية وذلك يعود إلى التفريط في إستعمال الأدوية ولا سيما تلك التي تصرف بدون وصفة طبية، زيادة على ذلك أن بعض الأدوية لا تظهر نتائجها الضارة إلا بعد فترة طويلة، كما أدى ذلك إلى ظهور حالات التسمم الناتجة عن تناول جرعات كبيرة من الأدوية بحيث تكفي لإحداث الموت.
ومن هنا، يظهر دور الصيدلي إلى جانب الطبيب لتقديم كل ما يمكن من أجل تفادي مصادر القلق وأسباب الخطر، وإزاء ذلك قد تقوم مسؤولية الصيدلي المدنية إذا ما استجمعت هذه المسؤولية شروط قيامه.
ومع وضوح الحقائق السابق ذكرها، فإن الذي يتطلع إلى الأبحاث القانونية ويلاحظ وبسهولة أن الصيدلي لم يحظ بذات الإهتمام الذي أولاه الشراح للطبيب رغم أن الواقع يؤكد أن دور الصيدلي أو مهمته لا تقل أهمية وأن مسؤوليته قد تكون أشد خطورة.
