اعترفت مختلف دول العالم بحق الطبيب في ممارسة أعماله الطبية ليقوم بواجبه المقدس والسامي بكل حرية في علاج المرضى، والعمل على شفائهم من الآلام، فالطب كغيره من العلوم في تقدم مستمر حتى إنّ الإنسان أو الطبيب يعجز أحياناً عن ملاحقة الجديد في هذا الميدان، وكان من شأن هذا التقدم أن تغيرت وسائل العلاج التقليدية، وظهرت وسائل فنية حديثة أكثر فاعلية في اكتشاف الحالات المرضية أو في علاجها أو الوقاية منها، وقد حققت هذه الوسائل إيجابيات وفوائد عديدة للبشرية. ومما لا شك فيه أنّ موضوع المسؤولية الجنائية للأعمال الطبية يعد من أكثر الموضوعات التي أثارت منذ عهد بعيد وما زالت تثير كثيراً من الجدل والنقاش والاجتهاد في مجال الفقه الجنائي والتطبيق القضائي، إضافة إلى الخلاف بين رجال القانون والأطباء، فالتطور المستمر في المجال الطبي وخصوصاً الأساليب الطبية المستخدمة أدت إلى إثارة مشكلات قانونية لم تكن موجودة من قبل، كما كان من شأن هذا التطور أن تجاوز الطب الحديث حدود الأعمال الطبية التقليدية عندما تعرض الكيان الجسدي للإنسان إلى انتهاكات خطيرة، فكان من الضرورة بمكان مواجهة المخاطر التي يتعرض لها الإنسان نتيجة المساس بحرمة الجسد، وتقرير المزيد من الحماية لحقوق المرضى، وبالتالي الرقابة الكافية على مهنة الطب للحد من الاعتداء على الحق في سلامة الجسم. ومن خلال التقدم العلمي تغيرت وسائل العلاج؛ من وسائل علاج تقليدية إلى وسائل علاج حديثة حققت إيجابيات وفوائد عديدة للبشرية؛ إذ أمكن التغلب على العديد من الأمراض، وحماية صحة الإنسان وحياته الخاصة، كما أمكن من خلال تلك الوسائل الحديثة مواجهة الظروف الصحيحة التي قد يتعرض لها الإنسان وتنعكس على حياته وعلاقته، وهذه الإجراءات الفنية الحديثة وغيرها ــ رغم أهميتها ــ إلا أن لها مخاطر تختلف جسامتها من حالة إلى أخرى، لذلك اختلفت الدول في مدى قبولها لهذه الوسائل الطبية الحديثة؛ فبعض الدول أولت اهتماماً خاصاً واتجهت إلى تعميقها وتطبيقها والاستفادة من معطياتها، والبعض الآخر لا يزال متردداً في ذلك، لعوامل مختلفة، منها اختلاف الثقافات والقيم والعادات، ومنها ما يتعلق بأن الوسائل التقليدية تتسم بالوضوح والبساطة من حيث طبيعتها وآثارها.
