لأن القوانين الدولية في حد ذاتها لا تكفي ومن الضرورات الحيوية التحقق من إحترام هذه القوانين وتتعهد الدول بسن أي تشريع يلزم لفرض عقوبات رادعة على الأشخاص الذين يرتكبون أو يأمرون بإرتكاب أيا من الانتهاكات الخطيرة سواء حددتها الاتفاقيات أو لم تحددها - ولقد سنت بعض الدول قوانين تحذر بعض الانتهاكات الخطيرة وإن كانت تلك القوانين غير وافية وقد آن الأوان لاستكمالها.
وفي هذه الدراسة سأبحث تحليل المسئولية الدولية عن انتهاكات قواعد القانون الدولي الإنساني وذلك على النحو التالي: الباب التمهيدي: نتناول فيه أساس القوة الإلزامية للقانون الدولي العام، الباب الأول: نتناول فيه بالدراسة القواعد الأساسية للقانون الدولي الإنساني بادئين بتعريف القانون الدولي الإنساني من حيث التعريف اللغوية والفقهية - ثم ننتقل إلى التطور التاريخي للقانون الدولي الإنساني، بدأ من العصور القديمة مروراً بالعصور الوسطى وصولاً إلى تطور القانون الدولي الإنساني في العصر الحديث ونتناول الوثائق الدولية والاتفاقيات الصادرة في ذلك ثم تدوين القانون الدولي الإنساني. والباب الثاني نتناول فيه المسئولية الدولية طبقاً لنظام القانون الدولي العام ونعرض أنواع المسئولية الدولية، مع ذكر الشروط التي يجب أن تتوافر حتى نكون بصدد مسئولية دولية ثم نتناول موانع المسئولية الدولية ، ثم نستعرض الآثار المترتبة على تلك المسئولية، مع توضيح المسئولية الدولية والسيادة الوطنية، ثم تحديد الطبيعة القانونية للمسئولية الدولية.
الباب الثالث: نوضح فيه مسئولية الدولة عن جرائم القانون الدولي الإنساني بعرض حالات إنتهاك القانون الدولي الإنساني والفئات المشمولة بحماية القانون الدولي الإنساني ونظم ووسائل كفالة الحماية المقررة لهم. الباب الرابع: نوضح فيه الرقابة الدولية على تطبيق أحكام القانون الدولي الإنساني باستعراض دور المحاكم الدولية الخاصة.
