يتمحور هذا الكتاب حول أفكار بسيطة، وطموح محدود جدا : 1- التذكير بالتساؤلات الأساسية التي تتيرها العقوبة نظريا أو التي أفصحت عنها الممارسة ؛ 2-الإلحاح على ضرورة عزل كل تساؤل؛ وتمييزه عن التساؤلات الأخرى؛ بالرغم مما يربطها من علاقة ومما طغى على محاولة الجواب عليها من تداخل وتفاعل أحيانا وخلط أحيانا أخرى؛ 3- التأكيد على ضرورة عدم الاكثرات بالأجوبة الجاهزة والمتداولة؛ وعدم التفضيل بينها؛ بل مواجهة ومقابلة بعضها ببعض لإظهار ما يخيم على موضوع العقوبة عموما من جهل وغموض وافتراض وتجريد؛ 4- إظهار الجدور النظرية لأزمة العقوبة؛ 5- التذكير بأن حياة العقوبة لاتتوقف على وجود أجوبة مقنعة وثابتة ومتفق عليها، ولا تكترث لذلك؛ 6- إثارة قضايا فرعية أخرى… وقد ينظر إلى ما تم الوصول إليه من نتائج؛ وخلاصات عامة أو وجزئية؛ كمحاولة للتشكيك في النظام الجنائي أو في العقوبة. وهذه قراءة أود التأكيد على مجانيتها ؛ وعبثها؛ لأن الأمر لايتعلق بعملية مدح أو هجاء بقدر مايستهدف : 1- انطلاقا من قاعدة " بضدها تعرف الأشياء " التأكيد بعد العروي على ضرورة تسجيل موضوع الحرية على رأس جدول أعمال اهتماماتنا. 2- اعتبارا لما يحوم حول العقوبة من جهل لهويتها؛ وغموض لمقاصدها؛ وافتراض لأساسها ؛ وتغلب الصدفة والحدس على مقياسها؛ المطالبة بعدم تقديس القواعد القانونية، وبالطبيعة الاستعجالية لاقتراح إصلاحات جدرية عليها، تساير ما يعرفه القانون المقارن من تجارب ومحاولات، وتضمن ما يتطلبه الانخراط في زمننا من احترام لحقوق الإنسان، وما يفرضه الوفاء لتراثنا من حماية للكرامة الإنسانية؛ 3- نظرا لما يتضمنه هذا الكتاب من ثغرات ونقصان ؛ فسح المجال لنقاش ؛ أتمنى أن يكون عميقا؛ وأن يتوخى كشف فكرة العقوبة؛ وإعادة النظر في كل ما يترتب عن ممارستها من نتائج.
