كتاب في أصول الفقه يجمع بين البعد النظري والمنحى التطبيقي الذي اشتمل على مناقشة جملة من العقود المالية المعاصرة.
سار البحث في الكتاب باتجاهين اثنين، علمي نظري، وعلمي تطبيقي، ففي الجانب العلمي النظري تناول تحديد مفهوم الذرائع في الفكر الأصولي، وبيان أسسه، ومجالاته، وضوابطه، وأصوله العامة. أما الجانب العملي التطبيقي فكان محاولة لتنزيل ما تم التوصل إليه في الجانب النظري، وإجرائه على المسائل المستجدة والنوازل المعاصرة في ميدان المعاملات المالية.
اشتملت الدراسة على بابين وخاتمة، أما الباب الأول فتوفر على تأصيل نظرية الذرائع في البحث الأصولي من خلال دراسة الأصول العامة للذرائع، وهجينها، وضوابطها. وتكون من ثلاثة فصول، الفصل الأول في الذرائع مفهوماً في اللغة والإصطلاح، وتاريخاً منذ نشأتها الأولى حتى عصر الأئمة المجتهدين، والفصل الثاني في بيان الذرائع من حيث أنواعها، وعلاقاتها بالأدلة الشرعية وبالمقاصد والقياس والمصالح المرسلة والاستحسان وغير ذلك، والفصل الثالث في عرض الأدلة حجية الذرائع، وتحليل أقوال الأصوليين فيها، ومواضع الخلاف والوفاق.
وأما الباب الثاني فيتضمن تطبيقات عملية لفكرة الذرائع على أهم صور العقود والمعاملات الماية الحديثة، وهي عقود الإذعان، وبيع التقسيط، والودائع المصرفية، ونظام التأمين. واشتمل الباب على أربعة فصول، الأًول الأصول الشرعية الكلية ومقاصدها العامة في الأموال، بينما خصصت الفصول الأخرى امناقشة تطبيق الذرائع على العقود المشار إليها.
وانتهت الخاتمة باستعراض أهم النتائج التي توصل إليها البحث، إضافة إلى عدد من التوصيات والاقتراحات.
مع تعقد المعاملات المالية في العصر الحديث.. ومع البحث عن أرض شرعية لتقوم عليها.. ومع الشبهات أو الذرائع التي تحوم حولها.. جاء هذا الكتاب يبحث في تلك المعاملات من وجهة نظر الذرائعية، المستندة إلى دراسة أكاديمية متخصصة في الموضوع. فهو يسد ثغرة هامة في مكتبة الدراسات الإسلامية عموماً، وفي أصول الفقه خصوصاً.
