يُثير القانون الدولي العام إشكاليات متعدّدة على المستويين النّظري والعملي، ترتبط بِتَعَدّد الأنسَاق الثّقافية والإجتماعية للمجتمعات البشرية وبتناقض وتعارض المصالح وسلوك الفاعلين (الشّركات المتعددة الجنسيات والمنظمات الدولية - الحكومية وغير الحكومية - والدول والأفراد...) على المسرح الدولي؛ فهناك من يرفض القانون الدولي كونه يحقّق مصالح الفاعلين الأقوياء إقتصادياً وسياسياً وتجارياً، وهناك من يقول إن القانون الدولي هو قانون لخدمة مصالح الضعفاء أو البلدان النّامية، في الوقت الذي يتوقف التّمسك بالقانون الدولي أو رفضه على مصالح الفاعلين وتوجهاتهم؛ فكلما أُتيحت للفاعل على المستوى الدولي فرصٌ لتعظيم مكاسبه يتمسك بالقانون الدولي، وكلما رأى أن مصالحه الحيوية مهدَّدة يلجأ إلى رفض القانون الدولي وتبعاته السياسية والقانونية والأخلاقية.
يسعى هذا الكتاب لإعادة التفكير في مدى قدرة القانون الدولي على فضّ المنازعات الدولية إعتماداً على القوّتين الخشنة والناعمة، وأهمية ردّ الإعتبار لعلم القانون وعلم السياسة وعلم الاجتماع والفلسفة وفق مقاربة متعددة الحقول المعرفية، لفهم نجاعة القانون الدولي أو عدم نجاعته، وبالتالي البحث عن الحلول غير المؤسّسية في التّنظيم الدولي؛ في ظل وجود تَدَافُع كبير بين الفاعلين من أجل إقتناص الفُرَص والإمكانات المتاحة وتحقيق مصالح معينة على حساب مصالح أخرى.
