يضم هذا الكتاب مجموعة من الدراسات التي تهدف إلى التعرف إلى المدينة الإسلامية باعتبارها فضاءً فقهياً استمر قائماً حتى مشارف العصر الحديث.
وقد أناط القاضي في المدينة والذي يعرف أيضاً باسم الحاكم الشرعي مسؤولية الرقابة في الأسواق إلى المحتسب تبعاً لمبدأ: الأمر بالمعروف والنهي عن المنكر.
إلا أن إحدى المشكلات التي لم تعالج كفاية تتعلق بعلاقة المدينة بالدولة، وبمعنى أدق تقاسم سلطة الرقابة في المدينة، بين حكم الفقهاء ونفوذ الدولة أو السياسة حسب ابن خلدون والمقريزي، وتسجل المؤلفات الفقهية التي اختصت بالسياسة الشرعية هذا الازدواج أو التناقض بين حكم الشرع وسلطة السياسة.
