أخذت قضية كشف الوجه وستره حيزا كبيرا في الفقه الإسلامي المعاصر، وأفرزت كثيرا من الحواجز الفقهية والاجتماعية بين المتبعين أو المقلدين للعلماء المختلفين. وأفرزت كذلك عن ضعف الأهلية لكثير من العلماء أو طلبة العلم في التعامل مع النصوص الشرعية ضمن القيود الاجتماعية أو العرفية إلى الحد الذي يتم فيه لي النصوص والتكلف في تأويلها للتتوافق مع تلك القيود والأعراف.
قسم هذا البحث النقدي إلى أقسام:
الأول: المعنى اللغوي للألفاظ المتعلقة بموضع الوجه، وهي الخمار، والجلباب، والقناع، والاعتجار، حيث إن تثبيت معاني هذه الألفاظ يسهل فهم النصوص الواردة.
الثاني: وضع النساء قبل نزول آيات اللباس الشرعي، حيث يسهم هذا أيضا في فهم النصوص.
الثالث: بعض القواعد الأصولية المتعلقة بالمبحث وهي:
قاعدة: أن ترك الأمر مع الحاجة إلى البيان يدل على عدم الإيجاب، كما أن ترك النهي مع الحاجة إلى البيان يدل على عدم النهي.
وقاعدة: إذا كان المقتضى لتحريم شيء في زمن النبي صلى الله عليه وسلم قائما، ولم يحرمه فإن تحريمه بعده بدعة.
وقاعدة: ما لا يتم المشروع إلا به فهو مشروع.
وقاعدة: لا إجماع بمخالفة الواحد من العلماء.
وقاعدة: لا تأمر الشريعة في العبادات بفعل ما هو محرم في غير العبادات.
وهذه القواعد تسهل عملية فهم الأحكام.
الرابع: أدلة مشروعية كشف الوجه، حيث أوردت فيه الآيات الكريمة وكل ما صح من النصوص النبوية وآثار الصحابة والتابعين، وبينت دلالتها البينة على مشروعية الكشف وأنه هو الأصل.
الخامس: المذاهب الفقهية في هذه المسألة.
السادس: الدراسة النقدية وهي نقد علمي لمن كتب في هذه المسألة وبيان الأخطاء الفقهية والأصولية، وبيان وجه التعصب ومخالفة أدب الخلاف.
السابع: خلاصة الحكم الشرعي.
