إن التصدر للإفتاء لا يكون إلا بعد أن يبلغ المرء شأوا بعيدا في العلم الشرعي، وفي الفقه على وجه الخصوص، وأن يكون بصيرا في تنزيل الأحكام الشرعية على النوازل تنزيلا يؤهله للإفتاء، وقد كان العالم الجليل الشيخ الإمام شمس الدين أحمد بن سليمان كمال باشا، المتوفى سنة 940 هـ، ممن تصدر للفتوى، فهو علم من أعلام الإسلام في القرن العاشر الهجري، وتولى مناصب كثيرة في الدولة العثمانية وآخرها شيخ الإسلام ومفتي الدولة العثمانية في عهد السلطان سليم، وأوائل عهد السلطان سليمان، وكتب في موضوع الفتوى كتابه «مهمات المفتي في فروع الحنفية»، جمع فيه فتاوى كثيرة، من كتب فقهية نادرة، بعضها مفقود، وبعضها مطبوع طبعات قديمة، يندر وجودها، ويصعب الوصول إلى عدد منها، ومن هنا احتفظ هذا الكتاب بنصوص قيمة، دعت إلى تحقيقه وإخراجه. وقد بذلت الوسع في تحقيقه وتوثيق نصوصه والتعليق عليها، ووقفت على إحدى اعتمدت عليها وقابلت بينها. عشرة نسخة، وانتخبت ست وجاءت الدراسة متضمنة الحديث عن الحياة السياسية والاجتماعية في العصر الذي عاش فيه أحمد كمال باشا، ثم التعريف بالمصنف اسمه ونسبه وشيوخه وتلاميذه ومصنفاته، ووفاته وأقوال العلماء فيه.
