تناولت في هذا البحث قضيتين من أهم قضايا الوقف المعاصرة حساسية وخطورة، وهما ((إدارة واستثمار أموال الوقف))، وذلك بالنظر في الفقه الإسلامي، ثم قراءة نقدية لأنظمة الإدارة العامة للأوقاف القطرية المتعلقة بهما. وشكلت إطارا ضابطا للموضوع من القواعد والضوابط الفقهية كالتصرف على الرعية منوط بالمصلحة وشرط الواقف كنص الشارع، ويفتي بكل ما هو أنفع للوقف فيما اختلف العلماء فيه. وقد استقر في الفقه الإسلامي القول بوجوب قيام إدارة الوقف بسائر الأعمال التي تحافظ على الموقوف، وتضمن بقاءه واستمراره، وكذا تحصيل الغلة، وتنفيذ شروط الواقفين، وتثمير الوقف واستغلاله بحسب طبيعة المال الموقوف؛ حتى يستمر ثواب الواقف ونفع الموقوف عليهم؛ ولهذا كان ريع الوقف مملوك لهم، وذلك بعد خصم مصروفات التشغيل والإدارة، والأمر متروك إليهم لترك بعض حقهم للاستثمار فيه من جهة الإدارة. ويعد ((استبدال الوقف، والاستدانة عليه)) من المسائل التي احتدم الخلاف حولهما، بسبب ما يترتب عليهما من منافع ومفاسد. هذا، وقد ثبتت فاعلية أنظمة الإدارة العامة للأوقاف بقطر؛ لاعتمادها منهج المؤسسية في إدارتها للوقف، واعترافها له بالشخصية الاعتبارية، وإبقائها على نمط النظارة الأهلية، واحترامها لإدارة الوقف، وتوظيفها وسائل الاتصال المعاصرة لخدمة الوقف، وإعفاء القوانين المتعاقبة أموال الوقف من كافة الرسوم والضرائب.
