Book Description
هذا الكتاب يحاول أن ينبه على ضرورة استعادة العلاقة بين الفكر الإسلامي وأصول الفقه، وتفعيل هذه العلاقة وتنميتها، ليكون أصول الفقه منهجا وخبرة ومعرفة حاضرا وفاعلا ومؤثرا في ساحة الفكر الإسلامي. كما أن هذه الدراسة ليست عن أصول الفقه علما، وإنما عن أصول الفقه فكرا، وهذا ما نحتاجه فعلا، فالدراسات في أصول الفقه كانت كثيرة، وهي التي استحوذت على الاهتمام قديما وحديثا، في حين أن الدراسات التي عنه كانت قليلة ومتفرقة ومتباعدة، لكنها تزايدت وأخذت وتيرة متصاعدة في فترة ما بعد ثمانينيات القرن العشرين. وما هو جدير بالإشارة، فإن الدراسات التي جاءت عن أصول الفقه، هي التي فتحت أمامه آفاق التجديد والتطوير، وبلورت مسارات واتجاهات هذه الآفاق، وهي التي أكدت حاجة هذا المنحى وضرورته في ساحة أصول الفقه، وكشفت عن قيمته وحيويته. وقد حاولنا قدر الإمكان أن تكون الدراسات في هذا الكتاب من نمط الدراسات الجديدة والحديثة، وأن تكشف عن الاتجاهات الجديدة في ساحة أصول الفقه، وتقدم جديدا في هذا المجال.
