إن الدراسة التي نقدمها عن تاريخ السجن والسجناء بالمغرب الوسيط محاولة لرصد الخلفية التاريخية للسجن في المغرب الوسيط باعتباره فضاء مصادرا للحرية، شأنه في ذلك شأن السجن في أي منطقة من المعمور، وفي أية فترة من فترات التاريخ. وتستمد دراسة السجن والسجناء في مغرب العصر الوسيط أهميتها من ارتباطها الوثيق بالغلبة، ومن كون الغلبة قائمة وقتئذ على العصبية بالمفهوم الخلدوني، والتي كانت مرتبطة بمزاج الحاكم، في غياب أي مؤسسات قانونية تنظم العلاقات بين الحاكم والمحكومين. ولا غرو أن الغلبة بما تقتضيه من امتلاك لوسائل الإخضاع والاستتباع ، فضلا عن الدعوة الدينية والتحكم في طرق التجارة بعيدة المدى، كانت الضامن الأساسي لاستمرار الحكم بالمغرب الوسيط. وإن مما له دلالته أن الأسطغرافية المغربية الوسيطية، وخاصة منها كتب التاريخ العام، تطنب في الحديث عن مختلف أشكال العنف، حتى ليبدو أن الإشادة باستعمالها جزء من تمجيد الحكم وانتصاره في دحر خصومه. ويعتبر السجن أحد وسائل العنف المتداولة بكثرة من لدن العصبيات المتعاقبة على تاريخ المغرب الوسيط في تقليم أظافر من لم يكن منسجما مع توجهات.
