ومن هذا المنطلق يقرأ تارد تطور المسطرة الجنائية والقضاء الجنائي بوصفه تاريخا لتحول أنماط الضبط الاجتماعي؛ إذ تتبدل صيغ المسؤولية والإثبات والتحقيق والمحاكمة بقدر ما تتغير البني الذهنية والقيمية المانحة للشرعية، وتعاد هندسة وظائف العقوبة من الانتقام والتمثيل الرمزي للسلطة إلى تقنيات الاحتواء والإصلاح. لذلك يفكك تارد مؤسسات القضاء - من هيئة المحلفين إلى أنظمة السجون والإعدام بوصفها أجهزة تنتج الحقيقة القضائية وتعيد توزيع الوصم والشرعية.
