تأتّتْ فكرةُ هذا الكتاب، بعد إلحاحِ مجموعةٍ من الأسئلةِ حولَ قوةِ اللغة، وحولَ الكيفياتِ التي تشتغلُ بها مكوناتُها اللّفظيةِ وغير اللفظية؛ فكيفَ يمكنُ أن تنتهي حياةٌ أسريةٌ بقولِ الزوج لزوجهِ: "أنتِ طالق"؟ أو أن تبدأ أخرى بقولِ أبي العروس: "زَوّجتُك ابنتي"؟ كيف يمكن أن نبكي بعد سماعِ قصيدة؟ أن تنبض جوارحُنا مع لفظةٍ قيلَت بحبّ؟ أو تتلون سلوكاتُنا بعد إعادةِ بناءِ معارفِنا أو حتى هدمِها؛ بشذراتٍ من عالَم اللّغة؟
أسئلة تطلبتْ محاولةُ الإجابة عنها خطَّ نهجٍ علميّ؛ بدأ بتحديدِ الحِجاج موضوعًا؛ وذلك لتمفصلِهِ في مكوناتِ الظاهرةِ الاجتماعية بسياقاتِها المختلفة، وتمظهراتِهِ السّلطويّة؛ فوقعَ الاختيارُ على الخطابِ القضائي؛ بسبب الآليةِ المؤسّسيّةِ التي تشتغلُ فيها لغتُه، تلك التي تتقاطعُ مع جلّ المفاهيمِ الحجاجية؛ من حيث بواعثهما وغاياتهما الموظفة إجرائيًّا في قاعاتِ المحاكم. و"لأنّ المعرفةَ أسيرةُ أدواتِها"، فقد وُظِّفتْ أدواتُ نظريتين تتكاملُ بهما دراسةُ الجوانبِ الإدراكيةِ واللّغوية؛ نهضتِ الأولى منهما على الأسسِ البلاغيةِ اليونانية، في حين أفادتِ الثانيةُ من الرؤى التي انبجستْ عن النظريةِ التداولية.
وباستخدامِ المَنهجَين: الوصفي والتداولي، وبالتطبيقِ على إحدى المُرافعات، ظهرتِ الآليةُ التي اشتغلت فيها اللغة، وبدا تناميها أثناء سيرورةِ الفعاليةِ الحجاجية، عبرَ تسخيرِ أطرافِ الخطابِ تقنيات متنوعة؛ بغيةَ التوصلِ إلى المقاصدِ، وتحقيقِ الإقناع –غاية الحِجاج.
