عرف المجتمع الجزائري في السنوات الأخيرة انتشار واسعا لإشكال مختلفة من الجرائم التي لم يعتاد أن يراها في الواقع، ومنها جرائم عصابات الأحياء التي أصبحت تمثل تهديدا صارخا لسلامة و أمن الأحياء و أفرادها و ممتلكاتهم، وتتكون هذه العصابات من المراهقين و الشباب البطال و حتى المدمنين و مروجين المخدرات، و كثيرا ما يكون المشاجرات و الإقتتال فيما بينهم في الشوارع و الأحياء أمام أنظار العامة من المواطنين و هذا ما يتسبب عادة حالات من الخوف و الذعر لهم، و بعد عجز الترسانة القانونية موجودة في التجريم و العقاب أعضائها فقد سعى المشرع الجزائري من خلال الأمر 03/20 المتعلق بالوقاية من عصابات الأحياء ومكافحتها على وضع آليات وقائية وردعية للحد من هذه الظاهرة وإرجاع الأمن و السلم الى طبيعته .
